As per South African law a person cannot be blacklisted after his debt expires. As per Stephan Logan of Logan Attorneys:
Unless the creditor obtained judgement within the three years before expiry, the creditor has no legal claim to the debt.In most of the cases the creditor is aware of the debt expiry but they try to relist the default. Therefore the debtor should check out the default date and find out if the creditor has obtained judgment to collect the debt. In case of a re-list of the default date the debtor should always consult the credit bureau to investigate the matter.
As per Logan:
Every day we see instances of consumers being abused by creditors simply because of their lack of knowledge of the law, and their rights under the law. It is about time every credit default listing on the credit bureaus complies with the Prescription Act.
