If you have written a significant amount of property in the name of your spouse then review it if you are in a verge of split. You need to call your attorney and re-write your Will if you are dying in the process of a separation. Even if you are physically fit a Will will control the division of real estate, life insurance, brokerage accounts, pension funds, cash between you and your spouse during the separation process.



In case of death before the separation process the spouse will inherit all your property, if your Will is reviwed before the separation process then she will be entitled only to the elective share.
